Legal Question in Real Estate Law in Colorado

HOA ammendment

We bought into a community that allowed 4 livestock. The HOA is trying to pass an ammendment limiting the livestock to be equine only if a certain percentage of the votes are in favor. Since we agreed to the CCR prior to this ammendment, and don't agree to it, would we legally have to abide by it? What if we had a non-equine livestock, would we be forced to get rid of it ir replace it if it died or was sold?

Re: HOA ammendment

The answer to your question largely depends on what the covenants governing your property say. In particular, is there a provision that allows the amendment of covenants? If there is no provision for the amendment of the covenants, then unanimous agreement among landowners is usually required for amendment.
