Release of Lien
A lien has been placed on our property by a sub-contractor. We have paid the contractor in full and have a statement from the contractor as well as a release of lien from him. The sub-contractor's lawyer has received this information, but refuses to release the lien. What can we do?

If you believe the lien is excessive or unjustified, you can file a lawsuit seeking damages. If the sub does not file suit to foreclose the lien within 6 months of last work, he will lose that right and the lien will expire. If you want to sell or refinance the property within 2 years, you might consider suit for excessive lien, otherwise let it lapse.
