Accessory to retail theft?

I was arrested for shoplifting. Leaving the store with four articles of clothing in my bag, then I was violently apprehended by three men in plain clothes. My friend did exit the store with me, but had no stolen merchandise on her person. We were both offered the same misdemeanor sentence. I suggested that she go to court (as she really didn't aid me at all). Can they actually charge us with the same crime? I desperately need to make this right.

They can charge you both. Complicity is the theory (very similar to accessory). The evidence must show that friend helped in some way, even just encouragement. Often they try to show that by saying friend was acting as a lookout.

I am not sure of the evidence against you guys, but just because you are charged does not make you guilty. A lawyer can help your friend, and you.
