not unless there are aggravating factors like a BAC over .20. Many judges give jail if there is an accident or for higher BAC levels. Some jurisdictions are tougher than others, so to give a good answer, I need to know that.

But, there is no mandatory jail on a first DUI where the defendant agrees to do alcohol classes and there are no other aggravators.
