I was recently arrested for dwia in Golden, CO. My court date is Oct. 2, 2007. I will be relocating to Philadelphia, PA the second week of October, 2007. The police officer told me that my license would not be suspended, and that I would only receive a fine and four points on my driving record, which would still allow me to relocate and keep my job. Is this true?

No! You are liable for a minimum of 8 points and jail time. See 42-4-1301 C.R.S. If you are leaving you should consider getting an attorney. It is possible that the attorney can handle the case for you without your being present. Please give me a call if you have questions at 303.806.5104.

DWAI is a lesser of DUI. It is given when the BAC is less than .08 but greater than .05. It is 8 points on your license and does not automatically suspend your license. If you have other points, it may. If you had another DUI in the last 5 years it will.
There is a way to do an out of state plea bargain where you do not need to return to Colorado. I get to Jeffco/Golden often, let me know.

You can relocate, but you may have to come back for court, do alcohol classes and public service. It depends on your alcohol level, the judge you get and your record. You should try to avoid an alcohol conviction if at all possible. It stays on your record for life. You need a DUI lawyer.
