Get my case dismissed.. I have 2000+cash . pulled over had everything valid. cop says he smells marijuana. and that i must be high on it right now. I said theres nothing in the car, and he might be smelling it off of our clothing from where we came from. but that i had not smoked any. he said to step out of the car wanted me to do a sobriety test. I did but, it was before my rights had been advised. He arrested me and said he could see it in my eyes. took me a detox, and was told to give a urine analyst i asked to speak with a lawyer to be advised of my rights, he said i didn't have sign the paper that i refused the UA. I only wanted to clarify that it wouldn't show up if it was weeks ago that i had smoked. he said it wouldn't and he could tell if i had just smoked. I needed further proof didn't submit to the test. I did do a breathalyzer and blew 0 everytime. never had a ticket. there were others in the car which weren't search, there was no evidence of marijuana. the smell could have came from anywhere i tried to explain it away, but he said it was me. please help. this is my lively hood i need to be able to drive, and my insurance is going to be expensive now. I'm prepared to clear out my lifesavings! PLEASE HELP

At DMV the issues are whether he had a basis to stop you, to request a test and whether you refused. At court the last issue is whether you were impaired. you should challenge it both places. You only have seven days to do so at DMV. If you had a valid license you will be able to drive until the hearing.

I have handled similar situations with success. I would be happy to discuss your matter at your convenience. You are presumed innocent. From what you describe, there is little evidence of guilt and several Constitutional issues to challenge. What County do you appear for court?
