Legal Question in Civil Litigation in Colorado

ok. im new at this and my english is not too good, but i need help on this situation. me and my brother own a condo in colorado that i use to live in, but i moved back to texas and i rented out, well the new tenets noved in july 2011 its a single mother so i was nice to her and told her we can work out the deposit, well i never got no deposit money,, and she is behind a month, las week she send me a text that she is moving cause the condo has mold and the kids are sick,that she was going to fax me the hospital letter and the lawyer letter.. i don't know what to do, and i ask her when is she moving out,, and she said the second week in december, i want her out since she hasn't paid last month and then two more weeks and she is sending me a lawyer. but i don't know what to do,, im planning to go to colorado and ask her to moved out but i don't want more problems, and the condo i need to do a short sale or foreclosed cause i can't afford it and i don't want to deal with the renters

You should hire an attorney to negotiate with the tenant. You flying out and asking her to leave will accomplish nothing. She can just tell you no she won't leave and you cannot just remove her. You will have to go through the eviction process and that could be weeks. You can negotiate now for a written stipulation that could shorten the time to get a writ (the order that allows for removal from the premises).

As to the short sale, you should contact a local real estate broker who has ample experience in this area. Contact an attorney as soon as possible so they can advise you on the tenant and other matters.
