A citizen requesting her son that overstayed in USA

I'm requesting my son , He entered with tourist visa and overstayed his limit of time here. I'm a citizen , His application has been approved and need time to wait for visa available. A lawyer told me that when the moment a visa is avai. he run the risk to be send back to my country Peru. Could you pls try to clear his situation.

If your son is unmarried and under 21, he can file an application for adjustment of status with the approved I-130 visa petition unless he is inadmissible for some reason. Otherwise, he must wait for a visa number to become available. I need to know more about him and the filing date of your visa petition to make a recommendation.
