Legal Question in Immigration Law in Colorado
If an ilegal immigrant marries a US citizen, will they be ban for ten years from returning to the US after returning to their country of origin for their interview?
1 Answer from Attorneys
If their extreme hardship waiver is approved, then they can come back after visa approval and don't have to wait 10 years abroad. If a waiver is denied, then, yes.
This applies to illegal immigrant who came to USA without a visa and inspection and stayed for over one year, and then left the country.
