i also am an iranian citizen.and i overstud my visa in usa becouse i had a case in prosses .i like to know if i'm in that 10 years ban category , will it be possible to apply for an E2 visa .my son is also a us citizen and if you could let me know about what are my chances will be great. What case you had in process? What did you file with the USCIS?

If you overstayed by more than 180 days, and then depart the USA, yes, you will become banned for 3 or 10 years.

If your son is a USA citizen and he is over 21 years of age, he can petition for you. If your son is a minor child, he can't petition for you.

If you are out of status, it wouldn't be possible to apply for a change of status to any other non-immigrant status.
