Legal Question in Personal Injury in Colorado

Blisters

I had used a coffee mug, that claims to be microwave safe, to reheat some tea. I had put the mug in for a minute and a half and stopped it at the one minute mark, as I took the mug out of the microwave, I realized quickly the mug was hot to the point of leaving large blisters on my fingers from the handle. I have done this with other mugs of different manufacturers and it was not that hot. The tea, by the way was not even warm as that went everywhere. I still have both mugs and have since then quit using them in the microwave. Would I be entitled to compensation? I have the blisters yet (day 2) and I still have the mugs. I was told how to check to see if something is microwave safe and followed the instructions and the coffee mugs that burnt me failed.

You would be entitled to any medical bills you had to pay related to the blisters, assuming you could prove the mug caused the accident, rather than inappropriate use of it. Unless someone watched you heat the tea, and timed it, that would be difficult, and even so would raise the question of why would somebody do that. A pain and suffering award for blisters, unless there was permanent damage, would be perishingly small.

I really think your best course would be to retire the mug as a hot-drink device, and tell all your friends not to buy one, unless it's for someone they wish would burn in hell, but would settle for a little burning now.
