Passenger in car that was rear ended

I was front seat passenger, we pulled over for oncoming emergency vehicles. A woman from another country in a borrowed vehicle was reaching for a baby's bottle and not paying attn smashed into us at about 45mph launching us into the rear of the car in front of us. Although I was injured (back and neck) I didn't hire an attorney. This was in 2006. I was recently offered over 30k to settle and now I don't know what to do! Any advice appreciated.

Call a personal injury recommended by someone you know, tell him or her about the offer, and see what happens. If they're offering 30K, it's because they think you could get much more. Do this ASAP, because there is a time limit to begin a lawsuit.

Before receiving the settlement money, you will be required to sign a release which will prevent you from filing a lawsuit for the damages you have suffered because of the accident � so you must be certain that the settlement amount is sufficient for your damages, or losses. You should consider three things when assessing the settlement amount � your expenses to date, your future expenses and any permanent impairment or injury you may have because of the accident. If you have only had a few thousand dollars in out of pocket expenses, including medical and any loss wages, and you do not anticipate future expenses, and no permanent injury, this offer might be in your best interest. But if your expenses or your injuries are significant then you might be better served by hiring an attorney. If you do hire a lawyer, typically you will pay one-third of whatever money is paid in settlement to the lawyer, so be certain that you believe that you can successfully argue that your claim is worth at least 35%-40% more than what is being offered. The fact that you have not yet hired a lawyer is telling, but you may want to talk to an experienced personal injury attorney before making a final decision � most offer free initial consultations. Keep in mind that for auto accident cases in Colorado, there is a three year statute of limitations, you must file your lawsuit within three years of the accident or lose your right to do so.
