personal injury at Target

My 79 year old mother was pused over by the cart boy pushing in the carts. She fell and fractured her hip. She was in the store but no one heard her cry for help. When the cart boy came in she told him to get help. He did not just wanted to help her up. Finally someone else noticed, mom told him she could not move her leags they stood her up leaning on something. Finally a customer gave her a chair. No manager came over. Went to hosp in ambulance had to have surgery. What can we expect and is it true they won't do anything until she is out of the rehabfacility. She was still working and is very concerned about all the bills.

Given the facts you provide, your mother may have a strong premise liability claim against Target. But the law in Colorado has undergone significant changes in just the past couple of years so it is critical that she talk to a lawyer with experience handling this type of claim. She should begin pursuing a claim immediately. There is no benefit to waiting to pursue fair compensation which would include damages for her past and future medical expenses, loss wages, permanent physical impairment and disfigurement and pain and suffering. Refrain from making any statements to the insurance or risk manager from Target, typically these are taken for defense purposes not to assist the victim in obtaining a fair settlement.

Absolutely hire a personal injury attorney. If your description here is accurate, you should sue Target. Not only are they responsible for their employee originally knocking her down, but there may be additional damages for standing her up on a broken hip, likely making her injury even worse. You should be able to find an attorney who will base his fee on a percentage of what you recover from Target. That attorney will calculate future costs as well as existing medical costs and punitive damages for gross negligence.
