Legal Question in Real Estate Law in Colorado

30 Day Notice on Rental Property

I am renting a property with a lease that has automatically become month-to-month. The lease simply states that a 30 day notice is required to vacate the property. I have given the landlord approximately 45 days notice and would like to vacate in the middle of a month on the 15th. Am I liable to pay for rent for the remaining days through the end of the month if the landlord does not get it rented by the 15th?

Re: 30 Day Notice on Rental Property

Depends. If your lease indicates that there are no partial months, then you have to pay for the full amount. If your lease does not, then likely no. If you told your LL that you want to move out in 45 days on the 15th of the following month and the LL said OK, then you should not have to pay the extra.
