Legal Question in Real Estate Law in Colorado

Can I break my lease

I have a lease that end in July that I want to know if I can get out of. I gave her 30days notice and I moved out. I have paid another months rent after that but I still have 2 more months to pay. Can I get out of this.

Re: Can I break my lease

You can always break a lease or any contract, but the worry is how much is it going to cost you.

Since you moved out and gave notice - I assume that was done with a written notice - your LL has a duty to try to re-let the place ASAP. Hopefully the LL will and then you are only responsible for the amount of the lease that was not covered by the new leasee.

If the LL does not try to mitigate the damages, then you may be able to win at trial for a reasonable amount.

Look at your lease - read it carefully. Is there some reason that the LL is not performing its duty??? If so, that may be a reason to break the lease, but usually you must give notice of the problem. If there is a problem, give the LL notice in writing asap.

Hope this helps.
