Legal Question in Real Estate Law in Colorado

Power pole right of way

I own a small farm in Colorado. I purchased the land and house from the person that I have a dispute with 15 years ago. The power line that provides electricity to my well has one power pole that is set on his property. Recently he said that if I didn't move the pole that he was going to cut it down. Can he legaly cut down the pole?

Re: Power pole right of way

Probably not. There may be an easement across his land for power to your land in the title records. If not, the courts may award you an easement if there is no way to get power to your well.

This question is fact specific and more info is necessary.

You might contact the power company servicing the line and tell them of your problem. They may be able to help solve this problem in order to continue providing service.
