How many people in a 2 Bed Apt?

My husband and I and our 3 kids moved into a 2 bedroom apt almost 2 years ago, and were put on the waiting list for a 3 bedroom apt at that time. Since then we had a baby (she is a year old now), and I recently found out that I am pregnant again. I just wanted to know if the Mgr/Owner can evict us for having too many people in the apt before a 3 bedroom becomes available. Also, with 7 people (once the baby is born) is that too many for a 3 bedroom? Thank you.

I do not know if there exists some city ordinance where you live which may or may not restrict the number of occupants in a dwelling; some cities require a certain amount of square footage per occupant. However, regardless of the law, if you signed a rental agreement that allows for a certain number of people and you have now voluntarily increased it (due to the availaiblity of birth control, pregnancy can be avoided if one does not want children) the landlord could give you a notice to vacate, if he chose to, because you would be in breach of your agreement.
