Broken contract

Our house is 50% completed. Contrctor got upset with us .He said we were interferring to much with the subs and now he said he's going to void the contract no matter what it cost. His wife is the realtor on the project and she called me and said her husband should not be dealing wiyh the public and that he is just fried. We've paid over 30,ooo dollars so far. Most of the people he uses as subs agree that he is to busy and they have a hard time dealing with him. It's usually his way or the highway'what's our recourse.

Dear LawGuru User:

The best way to proceed is to examine the contract you signed and see what remedies you have against the builder. Usually a contract has provisions that determine what action can be taken in the event of breach of the contract by the other party.

Depending upon the contract's terms, you may be able to terminate the builder and replace him. Please be very careful in doing this. You do not wish to create a cause of action in which the builder can sue you. Be sure to comply with every aspect of the contract and, if possible, have an attorney handle correspondence with the builder.

Please feel free to contact me with further questions.

Thank you for using LawGuru.

Sincerely,
