Can Joint Tenant file partition action?

I own a three unit rental property with another person. I thought we were listed as tenants-in-common but that is not the case. As a joint tenant is it possible for me to file a partition action?

Yes you can file a partition. I would definitely do something quickly to establish your rights because as joint tenants if you pass the entire rights go to the other party and vice versa.

Partition is complicated and the logical advice is to try to settle this matter first as the cost of partition is prohibitive. Good luck.
