Legal Question in Real Estate Law in Colorado
Loan carried on sale of parent's house
After both my parents passed away I sold their home and agreed to carry a loan of $36,900 for the buyer. He still owes me about $30,000. I even agreed to allow the buyer to refinance his primary loan earlier this year. When this month's payment came due and I had not received my payment from the buyer, I contacted him to ask why. Apparently he is looking for a lawyer to file bankruptcy. He is (mostly) self-employeed. What options, if any, do I have to get my money from him? Thank you!

I would have to see the loan documents to give a defintive opinion, but you should be able to foreclose on the property by bringing an action in the District Court where the property is located.
