We recently bought a house about 6 months ago. OUr sub division is on a private well that is maintained by a company
We recently had our pipes freeze. We found out via several sources that this is a major issue in the entire subdivision as the pipes were not buried deep enough. I guess about 3 yeaars ago the company that maintains the water did something to fix the issue of the main lines freezing, but our pipes were never buried deep enough as well and we have been told by several people that the previous owners had issues with the pipes freezing more that 3 or 4 times ove rthe period that they lived here.
we were told that htis should have been disclosed to us and it was not. IT probabaly would have kept us form buying hte house. We are in the process of having the pipes unfrozen which will run us a couple thousand dollars and to have the pipes permanetly fixed will run several thousand dollars. We have asked for mediation withthe previous owners and htey have not responded. WHat we are wonderign now is what type of evidence will stand up in court as that is our next step in this issue.

You need to contact an attorney because there are various claims that may be at issue including misrepresentation, constructive fraud, fraud (concealment or nondisclosure) and breach of contract. You need to prove all elements and the critical issue is knowledge and damages.
