Legal Question in Wills and Trusts in Colorado
accounting of estate
I am a legal heir listed on the will of my father. Am I
automatically entitled by law to a full complete accounting
of the assests of the estate by the personal representative,
who is my sister.
She moved to Washington state and refuses to reply to
any letters.
thanks

Re: accounting of estate
If you are listed as a beneficiary in your father's will, you are definitely entitled to review a copy of the Inventory (which your sister must file with the Court) and a final accounting as well. I recommend that you file a document with the Court, demanding to receive copies of these and all other documents, pleadings and orders filed in your father's estate. If your sister still does not cooperate, please feel free to call me.

Yes, you are entitled to an accounting as well as other information such as an Inventory. Your first step should be to file a Demand for Notice with the Court and also with the Personal Representative (PR). You should also visit with an attorney in the county where the estate is filed who is experienced with estate matters.
The PR does have time limits in which to file various pleadings, or deliver them to interested persons such as yourself. The Court clerks may also be of assistance to you.
Re: accounting of estate
You have the right to file a motion with the probate/district court asking the court to enter an order requiring her to file an accounting and/or an inventory and give you a copy. Further, if a personal representative fails to do the work required to probate the case, a motion can be filed requesting that the court appoint someone else who will.
