Legal Question in Wills and Trusts in Colorado

Can't find father's will, beneficiaries?

My father passed away recently and although we thought he had a will, we can't seem to locate one. We've tried all the avenues, and it's just not there. I have step siblings, and one full sister, who has been estranged from my father for nearly 10 years. If there isn't a will, does the estate go to myself and my sister, or just me, or all of us? Are step children included by law as beneficiaries? Are estranged children required to be notified?

Re: Can't find father's will, beneficiaries?

In certain cases, if a proper showing is made to the Court, it is possible for a copy of the Will to be admitted for administration.

Without a Will, then your father's estate will be administered intestate, that is without a Will. Colorado law provides for who the beneficiaries are in an intestate estate.

You should immediately engage the services of an experienced estate lawyer to assist you.
