Legal Question in Wills and Trusts in Colorado

Grandmother refuses to let anyone read great grandmothers will

My great grandmother passed away one week ago. She left a will which she kept in her safety deposit box. She had an executor which was supposed to read the will when she passed. My grandmother told him he was not needed and she took over. Now she will not let anyone see the will at all, which makes me tend to believe that she does not want any of the rest of the family to get what she left for them. Is there anything that can be done? Are there any laws that says the will has to be read. Thank You.

Re: Grandmother refuses to let anyone read great grandmothers will

By Colorado statute, the Will must be lodged at the District Court in the County where the decedent was living. When it is lodged it is a public record and you can read it.

You can force the Will to be lodged by filing a Demand for Notice and petitioning the Court for an order requiring that. Also, you could petition the Court to open the estate even if the holder of Will will not do so.

You should hire an attorney in your area that is experienced with probate litigation for more detailed advice before proceeding.
