Legal Question in Wills and Trusts in Colorado

Only son removed from trust

I am my fathers only child with a non-adopted stepsister and brother. When my father died his will was to have half go to me and half to my sister. Since my mother is still alive she has created a trust and removed me from it. I sold a business and house then moved my family halfway across the country to help her. My sister has been on crack cocaine for over 15 yrs and hasn't worked for nearly 20 yrs she will do nothing for my mother. My question is this am I completely out or do I have some way to save what is my fathers since growing up he always told me I was to take over and build the family fortune?

Re: Only son removed from trust

It would be important 1) to know whether your father and mother were still married when he died; 2) to be able to review your father's will; 3) to know when your father died and whether his estate is still open; 4) to konw whether your mother's trust is revocable; 5) to know whether your move across country was based upon any promise by your mother to name you as a beneficiary in her trust or will; and 6) to know how and with what assets your mother's trust was funded. More information may also be necessary to answer your question. I would recommend that you make an appointment with an attorney to thoroughly review your situation and determine what options, if any, you may have.
