All Alone in Colorado

I have a valid claim in Denver, CO. I have an Attorney that will not do as I have ask. Example:Twice I ask her not to continue a Hearing, as I wanted to speak to Judge. hearing was 5-18-99, now it's July. I ask her to scheldule a pre- conference hearing. She said it was a bad idea. I said no it's not. She won't do it. At first the claim was being contested, but I believe the employer tried to hide claim by paying cash. Can I go to Texas and still pursue claim. I am being evicted and have no where to go and not enough money to pay the rent.

My attorney also keeps telling me to get documents from co-workers saying I am hurt. The Carrier has accepted liability, so what is the purpose for documents.She says I have to get all medical records. How about final reports of surgeries. I have over 1000 pages of Medical Records in San Antonio.

Your question was whether you could take your claim to the State of Texas. Apparently, you have a claim in the State of Colorado with a good deal of medical treatment in Texas. It would necessary for you to consult a lawyer in Texas to see if you could file a claim there. It is unusual for two different states to have jurisdiction over the same case but not unheard of. It is necessary to examine the facts of your employment and the accident to determine which state has jurisdiction and if both may possibly have jurisdiction. I would caution you to also examine the benefits available to you in each state. At the present time, Texas has reduced benefits to where the lawyers will no longer take the cases. Colorado is not a very generous state either but it is still better than Texas. So, be very careful in deciding where to take your case.
