Legal Question in Workers Comp in Colorado
Is Total Permanent Disability within my reach?
Hello,
I have had pain since 1986 (cumulative stress
injuries), 3 surgeries (not successful), not been
able to work for 6+ years. I have RSD,
bi-laterial ulnar neuropathies, and TOS. My
impairment ratingis 41%. Have already been
granted SSD, (first time out). I am trying for TPD
and will have a hearing in a month or so. Much
documentation, from voc asses to Ime's stating I
cannot use upper extremities at any type of work.
What do you think my chances are of getting TPD?
Can you direct me to a source where I may look up
Hearing outcomes for simular cases in Co?

You question is one that involves the application of what appears to be Colorado law. In Iowa your claim would seem to be close and perhaps one in which permament total disability would be awarded. However your receipt of workers' compensation benefits will affect your social security benefits. Ask your lawyer about how to structure any settlement to lessen the effects on social security.
