Email server hijacked and distributing spam

Hello,

Recently an email server that I rent from a company has been hijacked and is now sending out mass emails for a pharmacutical company (http://senceben.com/). Do I have any legal recourse or is the easiest solution to merely have the company I rent the server patch the issue and forget about it?

You absolutely have standing to sue this company and come out with a VERY nice court award or settlement. However, most companies like the one that hijacked you are not located in the U.S., which makes jurisdiction to prosecute the biggest hurdle. However, if you are able to track them and/or their affiliates/agents down, corroborate your claim evidence, and identify the liable parties somewhere in the U.S., you have a STRONG case.
