Re: Following Steps

I would certainly recommend having a lawyer represent you, especially if there has been an accident. What could happen depends on whether your husband has been stopped before for DUI. It may also depend on whether anyone was hurt in the accident. Certain prosecutors and judges are more lenient with DUI, but in general the courts take these cases quite seriously. For more information about possible penalties, see the Driving Intoxicated section of the Criminal Law page of my website: http://www.serranolawyers.com/CriminalLaw.htm#DWI. Email me if you would like to discuss this further this weekend or call my office Monday morning.

No, you do not NEED a lawyer as you are entitled to proceed pro-se. However, it is not recommended. A DUI is a serious charge that should not been handled lightly. If you proceed pro-se, you risk making big mistakes that can be avoided by a well trained attorney. This is especially important if an accident is involved in addition to the DUI charge.
