Legal Question in Immigration Law in Connecticut

engaged to illegal immigrant

I am currently engaged to an Ecaudorian man who illegally entered the US almost four years ago. It is very important to me that my fiance be legal and in a position where he can live in the US and still be able to visit his family in Ecuador. Howver, I do not know if this is possible. I have heard a few different things concerning his potential to obtain a green card. Some say if we marry in the US we can do it but it will take about 10 years. Others say the only possible way is if we marry in Ecuador. I read online that an individual who has lived in the US illegally for more than one year will not be permitted re-entry for ten years after leaving. Is this true? Also, he has a tax ID number, a legal handi-man license, and a driver's license from Michigan. Will these things have any affect? Please inform me of our options. Thank you.

Re: engaged to illegal immigrant

Your fiancee will face a ten year bar for reentry to USA. However, there are waivers available depending on your case scenario. With respect to the actual sponsorship, there may be a way to process from within the USA if he meets any of the criteria under 245(i). I would require more information before providing a more definitive answer. Please contact [email protected] to schedule a consultation.
