Become a resident
Hi, I came to the US @ age 10 on a visitor's visa and overstayed it. Now, I am 20. At age 19 I was arrested and charged with 2nd degree forgery. I went to court and ended up getting some sort of probation, although it isn't real probation(something called ARP, somewhere along those lines). I also had to chose between paying $250 or doing community service. I chose to pay the fee. This program ends at Jan. 31st of 2008. I'd like to know, after that time will I be able to pass any kind of background/criminal check? I'm also not a resident. I was a temporary resident but my EAC expired. I also have a SSN and card but it clearly says not valid without INS authorization across the front. If I want to file for permanent resident, could my arrest affect this? Will I be a convicted felon? If the Z Visa program passes in the Senate and House, will I be able to pass a criminal check now? If not, will I be able after January when my ''probation'' is up? Without getting into the specifics of your case, as there are too many to discuss in this email, immigration law is tricky. However, to begin an analysis you would have to know what program you plead to and the offense charged.
