Legal Question in Immigration Law in Connecticut

Hello my Ex Wife has been in the Usa for almost 2 Years she is a Conditional us Citizen....We were Married March of 2008..I filed for Divorce in may 2009 was Final in October Through this she did not want the Divorce it was Uncontested But we Fought too much and Disagreed about things i was very Stubborn ..In late December i have been working on a Reconciliation...In April she Has to Apply for the I 751 Petition to remove Conditions it Expires in August...I need Advise I am not worried about her Petition i will help her,,But If things work out between us and i wanted to get Remarried befrore the Submission of Petition not a Good Idea??..Should it be Submitted with the Divorce Papers what if i wanted to Remarry after she gets her Card would there be Problems..She still has my Last name Please Help..Thanks......

Are you planning to remarry your ex-wife?

She can file an application to remove conditions I-751 even now (since you are already divorced she doesn't have to wait till April). She will need to request a waiver and prove a bona fide marriage which ended in divorce.

The issue will be whether yours was a legitimate marriage. Immigration will want to see documents to show a true marriage and an explanation of the break up.
