Equal Opportunity

My husband applied for a job having met all the qualifications for the position. The method of selection that was stated in the job posting was to be an ''oral board examination'' with a weight of 100% and a passing score of 70%. My husband submitted everything in time and received a letter that there was to be an extra WRITTEN exam with no description of exam only testing Cognitive ability. He went to the test and it was 50 questions in 12 minutes with a passing score of 17 correct, English is his second language and he could only answer 17 questions total. At the test he spoke with HR to explain that English is his 2nd language and would need more time for the test. She told him she did not have the test in his language and he said he does not need that he can do it in English but cannot read as fast as a native speaker. Following week he received a letter that he did not pass the test getting 14 correct. He called HR and left a message an HR rep called back later that day that there is nothing they can do even though he spoke to HR at the time of the test. HR said they would look into it and get back to him - called the next day told him that there was nothing they could do. Is this legal under equal employment opportunity?

I can attempt to help you with this issue. At first glance, I cannot determine whether the employer's action is legal. It does not seem like he had an equal opportunity but I would have to do further research to give you an exact opinion.
