Legal Question in Real Estate Law in Connecticut

Joint Ownership and selling a home in Connecticut

I equally own a home in Connecicut with my brother and sister. We need to sell the home but my brother refuses to sell or pay any ongoing expenses. Can my sister and I force the sale of the home without his approval. We would all share in the profits from the sale--name removed--I thought there there was a Conn law allowing the majority of owners to force a house sale.

Re: Joint Ownership and selling a home in Connecticut

You and your sister can file a "partition action" against your brother. (or you can file a partition action against both your siblings if your sister does not agree to join you.)

The property would either be divided amongst you if physically possible, (which is probably not the case here) or, in the alternative, ordered sold. Generally, this is done by auction if the parties do not come to some agreement. Usually, since no one wants an auction (there is no guarantee as to the auction price), parties usually reach an agreement to sell the property. (or someone buys the other out).

This is how you can "force" your brother to sell.
