property line dispute

My neighbors property line comes to the middle of my driveway- a driveway that was installed by the builder in 1984. He wants to put a fence along his line.The town won't help. What can I do? I'm a single mother.

Property line disputes are always frustrating, but you might have some options. Unfortunately, you are most likely going to have to retain an attorney to fix the problem, as you are likely in for a battle with the neighbor and the builder.

You should have an attorney review your existing deed and a full title search of your property and your neighbor's property. Most likely, you have a strong argument that your driveway includes an easement over the neighbor's property. Figuring out how to best argue that easement will require some legal research.

If you are on good terms with your neighbor, you can start by talking to him about the issue - by his putting up a fence, you will no longer have a driveway. Perhaps you can resolve the whole thing between your neighbor and yourself without pursuing legal action. If you can't, you are going to have to retain the services of an attorney.
