Legal Question in Traffic Law in Connecticut

Infraction information on ticket false, taking it to court, what to do.

Recently, I was pulled over by a state trooper doing 55 in a 40mph area. I was given a ticket for $110+

What I realized later was that I was actually doing 55 in a 45mph area even though the ticket and the officer said 40mph area.

I plan to take this to court, i also plan to take pictures of the speed signs in relation to where the trooper was.

My question is, how do i approach the court with this information? Also, what are my chances of not having to have my Insurance company find out about this?

Thanks in advance,

Matt

Re: Infraction information on ticket false, taking it to court, what to do.

I assume you got an infactions bureau summons. If you did, on the back of the summons, plead not guilty and send it to the address on the back for the infractions bureau. You will be give a date and location to appear. Go there early and request to speak to the State's attorney handling the MV for that day. Give you name and file #, if the file #'s are posted. They will call your name or will tell you where to go to discuss the matter. Present your pictures and any other evidence you have. Explain your situation to the State's attorney and you most likely get a reduction in the fine for acceptance or rejection. If you do not agree, you plead not guilty and request a trial. For the difference in the fine, I would not request a trial as it will cost much more to hire a lawyer for the trial than the fine. But, it is your right to request a trial and make the state prove its case. I hope this helps, Thomas F. Noonan
