Legal Question in Immigration Law in Delaware
is there any chance that i get work permit or i can stay in US on my wife status which she has green card since 2 and 1/2 years
1 Answer from Attorneys
No, unfortunately, you cannot stay in USA and get a work permit if your wife is a permanent resident (not a US citizen). If you have a long-term non-immigrant visa (such as, H-1B), then, yes, you might be able to stay. Otherwise, if you decide to overstay and caught by ICE/immigration, you can be referred to Immigration court for removal.
When your wife is a USA citizen, then she can petition for you and you can apply for adjustment of status (if in USA), or for an Immigrant visa (if abroad).
