Legal Question in Immigration Law in Delaware
I am a US Citizen. My boyfriend of three years is from El Salvador. We lived together here in the US for more than two of the three years we have been together. He was on TPS but we did not have all of the money we needed to renew his TPS on time so his papers expired and he went back to El Salvador. We are supposed to be married in March of 2011. If we get married there, are we EVER able to come back to the US as a couple? Am I waiving my US citizenship? Does he become a US citizen?

By marrying a foreign national, you do not waive your US citizenship and he will not become a US citizen. No, you will not be able to come back to USA as a couple immediately after marriage abroad. You can marry him in El Salvador, but you will have to petition for his immigrant visa with the USCIS. If approved, he will apply for a visa at the US embassy. If visa is issued, he can come to USA as a permanent resident. This is a long and sometimes complicated immigration process.
