Copyright Law Applied to Graffiti

Can a slogan, statement, or drawing on public or private property by a graffiti artist (not the property owner) be considered copyrighted and ''owned'' by the artist? Is it legal for a small business to replicate this art --name removed--g. on a t-shirt) and sell it without the artist's permission?

Yes, the artist can own it. And no, you may not use it without his permission except under special circumstances which do not appear to apply under the facts as given.
