publishing contracts

Can i get out of a contract with a publisher who has mis-represented themselves by re-writing the manuscript say 5-10%, calling it a different name and then selling it to someone else? It is new work.

I would need more information on the contract. What you describe sounds like the publisher may have plagiarized.
