Legal Question in Employment Law in District of Columbia
I am a former federal government employee. In 2006, I filed an EEO claim against the Dept of Treasury (Washington, D.C.) for race discrimination and retalitaion regarding protected activity. I requested a jury trial and this case was forwarded to an EEO Administrative Judge and is still pending (some 4 years later). In 2009, I also filed a Section 1981 claim against management officials for race discrimination and retaliation in regards to failure to promote. The agency has filed a Motion to Dismiss the Section 1981 claim based on sovereignty (federal government officials cannot be sued personally under this statute) and claims that the EEOC is the ONLY forum for federal government employees to seek redress. Are there any other state or federal laws that I can sue this agency for race discrimination and retalitaion??? I am a pro se litigant.

Part of the problem is you are a pro se litigant. You may have wasted valuable time by not retaining an attorney. The EEOC is set up to review claims of racial, sex, religion claims under 1983. You need to check with the EEOC to determine the status of the case. More importantly, you should retain counsel or at the minimum, schedule a consultation with an attorney. If you refuse to retain an attorney, you should take the time to review the discrimination laws. There are several law libraries, including the Library of Congress Law Library that you can use to become famimlar with the employment discrimination laws.
