Legal Question in Credit and Debt Law in Florida

I am the defendant in a civil matter with Citibank.

I have filed a sworn denial and a request for production of documents.

Plaintiff has filed on 10/08/2009 (trial is set for 11/04/2009) a MOTION FOR TELEPHONIC APPEARANCE OF WITNESS AT TRIAL.

This is a small claims case.

How do I object to this motion?

They have not responded to my request for production of documents(filed 09/30/2009)

Any help would be greatly appreciated.

First of all good for you for defending yourself against Citibank. File a Response to their motion for telephonic appearance at trial objecting to the witness not being live asap! How do you know who is on the other end of the phone? You have the right to questions witnesses about documents and statements, which is difficult to do over the phone. File a response to their motion and request the court to make the witness appear live.

With regard to your request for production, they have 30 days plus 5 days for mailing (if mailed originally) to respond to your request for production. So they have some time.

I would recommend retaining an attorney to assist you with this case there may be ways to defend your case that you are not aware of. The main question I would have for you is it Citibank you are up against or a debt purchaser in Citibank's shoes?
