can a company take money from an employee for mistakes made on payroll the year before. My check this week showed that they took out 34.00 for a mistake that they made in Nov of last year

Yes, a business can generally recoup funds paid in error to employees (there are exceptions to that generalization). Sorry; you likely have no cause of action, and even if you do fall into one of the exceptions, it's not worth it for $34; you'll pay easily $500 to the lawyer to represent you, or you'll pay the court costs for a self-represented small claims action, probably about $25. Either way, the cost of the litigation outweighs the possible return of funds from your employer.
