will a promissory note to loan my son money, witnessed, but not notarized or recorded hold up court in case of legal action

A promissory note does not need to be notarized. A witness is fine, although not even that is required.

Yes, but if you believe there is a good possibility of legal action being required you may want to reconsider loaning the money.
