Legal Question in Business Law in Florida

I bought hotel in Pensacola with my friend on Octber 1st 2007. We formed Florida LLC we both are 50% 50% owner of the LLC. LLC Own the Hotel.

I live in Alabama most of the time. My partner run the Hotel in Florida. Today I checked my business Bank Statement.. I found my business Partner Embezzled about $ 61,000.00 from Business Account to his personal name. He wrote three checks to his name without my knowledge and without informing me. one for $ 40,000.00 and other one for $ 20,000.00 and two Checks of $ 500.00 each. Please guide me what should I do?

You should get an attonrey to file suit against your partner. You probably want an attorney local to the case, but if you want to discuss further with my office please call.

You need to consult with an attorney immediately. You will have to file an emergency action and try to freeze all existing accounts. An accounting will have to be done of all the monies including both income and expenses to see if your figures are correct. If you can prove dishonest activity, then you will want to file a complaint with the police who may or may not get involved. They may tell you it is a civil matter and refuse to cooperate. Usually, if a person steals some money, they will take more.
