My elderly mother wants to collect her files from her present attorney and seek council elsewhere. The current lawyer will not see her, how should she request her files, in writing?

Yes, it is best that she put her request in writing and mail it certified. Lawyers have a professional/ethical duty to provide the client with a copy of his/her file. If the certified letter doesn't get the attorney to move, your mother can still proceed with the new attorney. It is not uncommon for the new attorney to request records from the previous attorney. Also, your mother may file a complaint on The Florida Bar's website against the previous attorney. That will surely get the lawyer's attention.
