Legal Question in Consumer Law in Florida
Fees for Service Rendered
I invoiced 75 days ago for services rendered and have not been paid since. The contract and invoice said due upon receipt. It did not specify any late fees. Can I charge late fees now?

Probably not since not provided for in the contract and/or invoice. If you would like to have a demand letter sent and/or initiate litigation, please feel free to call my office.

No. But you are due interest at the statutory rate, which is 11%

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
If your contract did not provide for late fees, you would not be able to charge them at this point. You may be entitled to interest at the statutory rate (which varies each year) but if you charge additional items, you may face having a judge strike all of the charges.
