Legal Question in Consumer Law in Florida
restocking fees on lemons
I purchased an ATT mobile phone at an independent dealer and it is a lemon.
They want to charge me $100.00 to return it (25% restocking fee on $400 purchase price).
Is there a law covering such fees for defective items? Where can I find this information? many thanks

Re: restocking fees on lemons
If the phone is defective, then there is no restocking fee. If you just don't like it and want to return it (which is how they are dealing with your complaint), then the sales contract may provide for a restocking fee.
