Legal Question in Consumer Law in Florida

returning new vehicle

Can you return a new vehicle after a week when you realize you can not make the payment. The dealership pushed a 2008 truck retailed at $50,000 to my 22 year old.

No. Once the agreement is signed and the vehicle leaves the lot, it generally cannot be returned. At 22 a person is an adult and is able to bind him or herself on a contract. You may be able to negotiate a buyout of this purchase agreement but it is doubtful that the dealership will accept the return of the car and a cancellation of the contract.

Re: returning new vehicle

You cannot return however if your son was pressured then a lawyer's letter threatening to sue under the Unfair & Deceptive Trade Practices Act sometimes gets the dealership to agree to accept a return to avoid litigation costs. If you would like a consult, please call.

Re: returning new vehicle

Nope -- you cannot return it without their consent. A contract is a contract.
