Legal Question in Consumer Law in Florida
Time share purchase and sale contract breach
I'm not really sure if the related area law is that of consumers or should be real state.Anyway,on late 1996,in Florida,I've signed up a contract for buying what its called time share. As stated on contract I made monthly payments til march 98.I stopped paying because I submerged in terrible economical conditions.Nevertheless I wrot a letter to the seller cancelling the contract and also gave up all I have already payed.I did never use the interval time share I bought.Although the letter was sent registered I did never get any answer.By the time of the settlement the seller had I person fluently in portuguese as I don't speak english (someone else wrotte this letter).Now,4 years later I received I letter from them and someone in Florida who speaks portuguese very well calls me almost every day. They want me to sign a document in order to cancell the contract I thougt was cancelled since march 1998.And they say if I don't do it I will be sued and down in USA.Is that correct? Can they do this? The letter I sent them does not mean anything? Has no legal value I had given up all I have payed since december 1996 until march 1998,giving them back the interval time shared? What sould I do?
Thanks for the help.

Re: Time share purchase and sale contract breach
I believe it would be extremely prudent for you to meet with a Florida real estate attorney to review your documentation and see what your position really is. It may be best for you to simply sign the requested document if it does not place you in further jeopardy but I am unable to render a legal opinion without viewing the pertinent documentation.
